Terms of Use

These Terms of Use ("Terms") govern your use of the Easy Tagger desktop application ("Application"), operated by an individual developer based in Serbia ("Developer", "I", "me", or "my").
By installing or using the Application, you agree to these Terms.
1. License Grant
The Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Application for personal or commercial use, subject to these Terms.
This license is bound to a specific device using a generated hashed device identifier.
2. License Restrictions
You may not:
- Copy, modify, or distribute the Application;
- Reverse engineer, decompile, or attempt to extract source code;
- Bypass license validation mechanisms;
- Resell, sublicense, or redistribute the Application without permission;
- Use the Application for unlawful purposes.
3. License Activation and Hardware Binding
The Application uses a hashed device identifier generated from hardware information to bind licenses to a specific device.
You are responsible for ensuring your hardware remains compatible. Significant hardware changes may require license revalidation.
The Developer reserves the right to deny activation in cases of suspected abuse or license circumvention.
4. AI Services and Third-Party Providers
The Application integrates APIs provided by:
- OpenAI
- Google (Gemini)
The Application transmits images to the selected AI provider for analysis.
The Developer does not control and is not responsible for:
- Availability of third-party AI services;
- Changes in pricing or API policies;
- Data handling practices of the AI provider;
- Service interruptions or API failures.
You are responsible for complying with the terms of the selected AI provider.
5. AI Output Disclaimer
The Application generates automated tags using artificial intelligence.
AI-generated content may be inaccurate, incomplete, or inappropriate. The Developer does not guarantee the accuracy, reliability, or suitability of generated tags.
You are solely responsible for reviewing and validating all generated content before use.
6. API Keys
You are responsible for securing and managing your own API keys.
The Developer is not liable for misuse, exposure, billing charges, or unauthorized usage of your API credentials.
7. No Warranties
The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
The Developer disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, the Developer shall not be liable for:
- Indirect, incidental, or consequential damages;
- Loss of profits, data, or business opportunities;
- AI output inaccuracies;
- Third-party service disruptions;
- Hardware compatibility issues.
Total liability shall not exceed the amount paid for the license.
9. Termination
The Developer reserves the right to terminate or suspend licenses in cases of violation of these Terms.
Upon termination, you must cease use of the Application.
10. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Serbia.
11. Changes to These Terms
The Developer may update these Terms from time to time. Updated versions will be published on the official website.
